Den 25. september 1888 døde Ellen Kirstine Christensen i hjemmet på sydsiden 4th Street mellem "K" Street og "L" Street i Fremont. Efter at have solgt nybyggerstederne syd på i Saunders County havde Jens Christian Jensen Fjeldgaard nemlig i august 1883 købt et hus der i den sydlige udkant af Fremont By, hvor familien kom til at bo de følgende år. Året efter havde han tillige købt en lille farm på 3 acres af Johanne Andersen ved den vestlige bygrænse, hvorfra han kørte rundt til kunder i byen og solgte frisk mælk ved gadedørene. I 1885-folketællingen er Jens Chr. Fjeldgaard således tituleret "milk-peddler".

Datteren Mary blev som ganske ung i 1887 ( hun var knap fyldt 17 år ! )  gift Jens Christian Jensen. Navnet kan skabe lidt forvirring, fordi Jens Chr. Fjeldgaard og sønnen Jens hjemme i Bolleskov jo egentlig bar samme navn. Det unge par overtog efterhånden driften af landbruget, så den nu efterhånden gamle og noget gigtplagede Fjeldgaard kunne slippe tøjlerne. Han fortæller selv i et brev hjem til datteren Karen, at han til tider nærmest ikke kunne gå uden støtte af sin stok.

I 1888 bliver han så enkemand - for anden gang ! Der er ingen tvivl om, at han følte et stort savn, og at ensomheden ofte tyngede ham. Han skriver fra tid til anden om savnet i sine breve hjem til Danmark.
 
Skiftematerialet efter Ellen Kirstine er arkiveret på dommerkontoret i Fremont. Det indeholder de helt formelle dokumenter, erklæringer og kvitteringer, men også en fuldmagt fra Ellen Kirstines søn Jens Martinus hjemme i Danmark. Han havde været hos notaren i Nørresundby for at give fuldmagt til sin svoger Jens Peter Pedersen. Fuldmagten foreligger også i en engelsk oversættelse.

THE STATE OF NEBRASKA - County of  Dodge - ss

At a County Court for the County of Dodge holden at the County Judge’s office in the City of Fremont, on Monday the 1. Day of October in the year one thousand eight hundred eighty eight.

IN THE MATTER OF the Estate of Ellen C. Felgard, deceased.


On reading and filing the petition, duly verified, of Mary Jensen, daughter of said deceased setting forth among other things that said Ellen C. Felgard died intestate leaving personal property in the State and praying to the Court that James C Felgard be appointed Administrator of said estate. Therenpon it is ordered, that Friday, the 19 day of October 1888 next at 10 o'clock in the forenoon, be assigned for the hearing of said petition, and that the heirs at law of the said deceased, and all other persons appear at the session of said Court then to be holden at the County Judge’s office in Fremont and show cause, if any there be, why the prayer of the petitioner should not be granted. And it is further ordered that said petitioner give notice to the heirs and all persons interested in said estate of the pendency of said petition, and the hearing thereof, by causing a copy of this order to be published in the "Fremont Herald ", a newspaper printed and circulated in said County of Dodge, three successive weeks previous to said day of hearing.

Petition for Letters of Administration 


In the County Court of Dodge County, Nebraska 

Your Petioner, Mary Jensen, the daughter of said Ellen C Felgard, late of said County, deceased, respectfully states that said Ellen C. Feldgard departed this life on the 25 day of September 1888, that she was immediately proceding her death, a resident of said County. Your petitioner further shows that no last will and testament of said deceased has been discovered, nor is your petitioner aware of the existence og any such instrument, and petitioner believes that said Ellen C. Felgard died intestate and left surviving James C Felgard, her husbond, James M Christensen, her son and Mrs. Anna Peterson and Mrs. Mary Jensen, her daughters, her only heirs at law and she left personal proferty in the State of Nebraska not to exceed in value $ 1000 Dollars Wherefore petitioner prays that letters of administration may be granted to James C. Felgard upon the goods, chattels, rights and credits of said Ellen C. Felgard, deceased.    Mary Jensen

Petersen, boende i Fremont, Dodge County, Nebraska, North Amerika, Box 126, uindskrænket Fuldmagt til for mig at give Møde paa Skiftet efter min afdøde Moder, Ellen Kirstine Fjeldgaard, født Christensen, og paa dette Skifte varetage min Interesse i enhver Henseende, saaledes at han med fuld forbindende Virkning for mig kan tage Bestemmelse i enhver under Skiftet forefaldende Tilfælde samt have og kvittere for den mig tilfaldende Arv. - Alt som om jeg selv havde været tilstede og taget Bestemmelse.

Til Bekræftelse har jeg i Overværelse af Notarius publicus for Kjær Herred underskrevet foranstaaende Fuldmagt.

Power of Attorney

I, the undersigned, Jens Martinus Christensen, a laborer of Orum, do hereby give and grant unto my brother-in-law James P. Peterson, residing in Fremont, Dodge County, Nebraska, North America ( P.O. Box 126 ) unrestricted power of attorney to represent me in the administration of the estate of my deceased mother, Ellen Kirstine Fjeldgaard, nee Christensen, and in the said administration to have the handling of all my interests in every respect, in that he may with full and binding force and effect take all necessary action and do every necessary thing under said administration in connection with any matter that may arise, as well also as to receive and recept for my share of the inheritance, - doing all as fully as I might and could do of personally present and acting in person. In testimory whereof I have signed the foregoing power of attorney in presence of the Notary Public of Kjaer Herred at North Sundby the 23d day of November 1888. Jens Martinus Christensen Kjaer Herred, North Sundby November 23d A.D. 1888 personally appeared in the Notarial Office of Kjaer Herred Jens Martinus Christensen, laborer of Orum and signed with his own hand and in the sound use og his mind the foregoing power of attorney in the presence of the undersigned, Jens Jensen, a duly constituted Notary Public, after the same had been duly read in his hearing and his identity had been fully established to me by Christen Sorensen, a householder of Orum and Andreas Carl Christensen of North Sundby, above names appear heron also as notarial witnesses. Felgard deceased, and residing in Denmark, Europe which Power of Attorney is filed in said County Court. And I by virtue of said Power of Attorney do certify by these presence that I have received of Jens C. J. Feldgard Administrator of the Estate of Ellen C. Felgard deceased the sum of Three Hundred Forty One 65/100 Dollars in full of his share due him from the risidue of the Estate of Ellen C. Felgard deceased and I further pray the County Court to discharge said Jens C. J. Felgard Administrator of said estate from all further dueties under the said trust.

Felgard deceased and I further pray the County Court shall discharge said administrator of said estate from all further duties under said trust.

Felgard deceased, respectfully shows: That he has fully administered the estate of said deceased and paid all debts, funeral charges and expenses of administration, as will appear from his account of his administration herewith rendered. That the residue of said estate in his hands consists of not anything. The said money having distributed to the heirs of said deceased by me of the amount of $ 1015 Dollars. The residue in full of the the Estate of Ellen C. Felgard, deceased. That there is no children under the legal age. That said deceased left surviving Jens C. J. Feldgard, her husbond, James M. Christensen, her son residing in Denmark and Mrs. Anna Peterson and Mrs. Mary Jensen, her daughters and only heirs at law. Wherefore, Petitioner prays that his said account be allowed, and that he be discharged from all further duties under said trust.
